Information and request for consent to the processing of personal data pursuant to art. 6.1A of Regulation (EU) 2016/679

In compliance with the obligations laid down in Regulation (EU) 2016/679 on the processing of personal data in force since 25 May 2018, we hereby wish to inform you that the company MIA srl with registered office in Via Paolo VI 16, 25010 Acquafredda (Bs) (hereinafter the “Company”) will process the personal data concerning you and that have been or will be communicated to us by you or by others. The processing of personal data will be carried out in compliance with the regulations in force and under the following conditions.

1- Purpose of the treatment

The processing of personal data is directed exclusively to the achievement of the following purposes:

a) for requirements preliminary to the stipulation of contracts of sale, to execute the same and for the protection of creditors’ positions and resulting from them;
b) in order to fulfil any type of obligation provided for by laws or regulations in force, in particular, in fiscal matters;
(c) for operational, management and accounting needs;
d) for the registration of accesses to the Company’s website and the use of the services provided with such site;
(e) for the purposes of monitoring the development of customer relationships and/or the associated risks and improving those relationships;
f) for commercial purposes and strategic and operational marketing.

2- Treatment modalities

The processing of data may consist, in addition to their collection, in their recording, organization, structuring, storage, adaptation, modification, extraction, consultation, use, communication by transmission, diffusion or any other form of making available, comparison or interconnection, limitation, cancellation or destruction and will be carried out both with the use of paper support, and with the aid of electronic computer and telematic tools, according to methods and with instruments suitable to guarantee the security and confidentiality of the data, in accordance with the provisions of Articles 32 et seq. of Regulation (EU) 2016/679, relating to the “security of personal data”.

In particular, all technical, IT, organizational, logistical and procedural security measures appropriate to the level of risk according to the nature of the data will be adopted.

Furthermore, the methodologies applied guarantee that access to the data is allowed only to the persons entrusted with the processing by our Company.

3- Data transfer

The provision of data is:

  1. Obligatory for the achievement of purposes related to obligations under laws or other binding regulations;
  2. Necessary for the correct establishment and continuation of the relationship with you.

Any refusal to provide the above data, although certainly legitimate, could compromise the smooth running of the relationship with our Company and, in particular, could make it impossible for us to execute your orders, as well as to perform the services requested and the related billing.

4- Communication and dissemination of data

The communication to the outside world of personal data collected for the purposes referred to in paragraph 1 may take place only where:

  1. such communication is compulsory to ensure compliance with the requirements of the law or other binding regulations;
  2. such communication is obligatory to ensure the correct establishment or continuation of the business relationship with you.

The personal data collected for the achievement of the above-mentioned purposes may be communicated, as far as their specific competence is concerned, to public and private entities, natural and/or legal persons and having commercial purposes and/or management of information and/or payment systems, including external data processors and sub-processors who carry out specific tasks on behalf of our Company.

In particular, the data may be communicated to the following categories of subjects: sales network, banking institutions and companies specialising in payment management, legal and consultancy firms, subjects responsible for auditing the financial statements of our company, public authorities or administrations for compliance with the law, Italian and foreign suppliers, financing and transport companies, third parties responsible for controlling the quality of the logistical-commercial flow, as well as other companies that are part of our Group.

The data may also be disseminated, but only in aggregate form, anonymously and for statistical purposes in accordance with the law.

5- Transfer of data abroad

To the extent strictly necessary for the performance of the ongoing contractual relationship with you, your personal data may be communicated to third parties (such as suppliers) located abroad, inside or outside the European Union always with respect to the rules contained in Articles 44 to 50 of Regulation (EU) 2016/679.

6- Rights of the interested party

Pursuant to Articles 12 and15 to 22 of Regulation (EU) 2016/679, you have/have the right to request, subject to the requirements and limitations of the said Regulation, to:

  1. Access to personal data
  2. Rectify inaccurate personal data
  3. Delete personal data
  4. Limit the processing of personal data
  5. Receive notification in case of rectification, deletion or restriction of personal data.
  6. Portability of personal data
  7. Opposition to the processing of personal data
  8. With regard to automated decision-making processes (including profiling):
    1. Getting human intervention from the owner.
    2. Expressing your opinion
    3. Challenge the decision.

7- Owner and responsible person

We also confirm that the data controller is the undersigned company, in the person of its pro tempore legal representative, with registered office in via Paolo VI 16, 25010 Acquafredda (Bs). The person responsible for the processing of your data, domiciled for this purpose at the Company’s registered office, is the IT Services Manager, who can be contacted by e-mail: info@mia-group.it.

9- Consent to treatment

We would like to inform you, finally, that the provision of consent by you to the processing of personal data in the manner and for the purposes described above is optional. In the event of your refusal to give your consent, our Company will not be able to process your personal data, but only to use them in compliance with the obligations provided by law or other existing regulations, with the possible consequences described in point 3 above.

As you are aware, Regulation (EU) 2016/679 provides that the processing of personal data is carried out with the consent of the data subject, except in cases of exclusion specifically indicated by the law itself. For this reason, we invite you to fill in the electronic consent request form as an acknowledgement of receipt of the information contained in this information letter, as well as an expression of consent to the processing of personal data.
